Opportunities and Challenges for October 2024 PII Renewals

Opportunities and challenges for October 2024 PII renewals

As we approach the October 2024 Professional Indemnity Insurance (PII) renewal period, law firms are finally experiencing a more favourable market, marked by increased capacity and greater flexibility from insurers.

This change presents more opportunities for law firms to secure longer-term policies and potentially reduce their premiums. However, while the softening market is welcome news, it also brings potential challenges that firms must carefully consider, particularly in relation to premium funding and cash flow management.

Increased insurance capacity and flexibility

Recent reports indicate that a significant portion of law firms are taking advantage of the current market conditions by opting for longer-term insurance policies. With 26% of firms that renewed in April 2024 securing policies lasting more than a year, compared to just 3% in April 2023. It is clear that the appetite for extended coverage is growing.

Moreover, three new insurers have now joined the Solicitors Regulation Authority’s (SRA) participating insurers list and there is a general willingness amongst existing insurers to relax certain restrictions.

Underwriters are now more open to reviewing proposals from firms that were previously considered high risk. This is particularly the case for those with a strong focus on conveyancing work. This increased competition among insurers is driving rate reductions for many firms, making this an ideal time to explore renewal options.

Challenges in premium funding and cash flow

Despite the positive outlook for securing more favourable PII terms, firms must remain vigilant about potential challenges related to premium funding. The shift towards longer-term policies, although beneficial in spreading risk and locking in favourable rates, may also require significant upfront premium payments. This could strain cash flow, particularly for smaller firms or those already facing financial pressures.

Moreover, while underwriters are keen to attract and retain firms they consider to be “good” risks, this does not eliminate the need for robust risk management practices. As claims against solicitors can increase during times of economic uncertainty, law firms must ensure that their risk management strategies are thoroughly documented and communicated to insurers.

Areas such as wills, trusts, probate, and estate administration have seen a rise in claims, making them critical focal points for firms looking to mitigate potential liabilities.

Preparing your firm for PII renewal

To ensure that renewal proposals are viewed favourably, it is essential that Solicitors  provide a good quality presentation including an insight into the practice through a narrative which ‘paints a picture’ of the firm, its ethos, processes, supervision and management.  For firms who have experienced claims, it is essential that they elaborate of remedial action taken to ensure that future risks of a reoccurrence are minimised; including the  review and strengthen their risk management protocols, particularly in areas that have seen an uptick in claims.

As recommended by the Law Society, solicitors need to be organised and should prepare and submit their applications months in advance. A large proportion of solicitors do not submit their presentations until the last four weeks leading up to renewal, and others miss the deadline completely.

Firms may also wish to exit specific areas of law, especially if they are operating in high-risk areas. Exiting a market can also help law firms improve their cash flow by allowing them to free up WIP and focus on more profitable areas of law.
