The legal industry has witnessed a notable increase in law firm closures in recent years. This trend has been attributed to various factors, including the tightening regulatory framework imposed by the Solicitors Regulation Authority (SRA).
Recovery First can assist law firms facing financial difficulties to find solutions, helping them to avoid SRA firm closure.
An increase in SRA firm closure cases
In the 2022/23 year (ending October 31), the Solicitors Regulation Authority (SRA) intervened to close 43 law firms, accounting for 13% of all closures. This marked a significant increase of 87% compared to the 23 firms shut down in the previous year. A large number of these closures involved cases where law firms mishandled client funds, with some incidents gaining widespread attention.
One of the most notable cases was the closure of Axiom Ince in October 2023 after £64 million was withdrawn from its client account and subsequently vanished.
In July 2024, the SRA issued a warning to all law firms regarding the mishandling of client money. This signalled a more aggressive stance on the issue.
Ian Johnson, a partner in the field, commented, “The SRA has really intensified its interventions. Law firms must be aware of the heightened regulatory scrutiny they’re facing.” He added, “Given the high-profile nature of the Axiom Ince case, the SRA is now on high alert for any signs of mishandling client funds and is determined to take swift action to shut down firms involved in such activities.”
The financial challenges faced by law firms have contributed significantly to the rise in closures. Out of 327 law firms that closed last year, 44 were directly impacted by financial stress, which has been exacerbated by rising interest rates and increased staff costs.
Johnson noted that salary inflation, which has originated from large city firms, has spread to regional and high street firms, increasing their operational costs. He explained, “Many firms have closed due to financial pressures, and when financial strain increases, some firms may turn to client money to cover expenses, raising the risk of regulatory intervention.”
Another major factor in closures has been the retirement of senior partners. In 81 cases (25% of closures), firms were unable to find internal successors or complete a sale, leading to their closure.
Johnson emphasised that internal succession is often the preferred option for retiring owners, as it protects the interest of clients and avoids the complications of a lengthy sale process. However, he also acknowledged that succession planning remains a significant challenge, particularly for smaller firms.
He concluded, “The retirement of senior partners has been the primary cause of closures, especially among small firms, and succession planning continues to be a major hurdle for many of them.”
Avoiding SRA intervention when facing financial issues
Avoiding SRA intervention is crucial for managing and mitigating a firm’s growing debts. The best approach is to take proactive measures early. Tackling underlying issues promptly can demonstrate to the SRA that closing down your practice is unnecessary. In some instances, this may involve voluntarily closing or restructuring the firm to address challenges effectively.
Recovery First can assist firms facing financial difficulties in the process of restructuring or closing their firms in an orderly manner to avoid SRA intervention.
We also work alongside professional service providers, such as insolvency practitioners to discreetly sell a firm’s cases to multiple purchasers on their panel of solicitors. This mitigates the risks to the buying firms and results in a higher value for the work in progress (WIP) being recovered whilst ensuring SRA compliance.
Moreover, it doesn’t have to be all the firm’s cases. Recovery First can equally work on discrete tranches of cases or particular claim types.
